Welcome to the website for the administration of the Merck ERISA Litigation

This website has been established to provide general information related to the Litigation and resulting Settlement Fund. The capitalized terms used on this website, and not defined herein, shall have the same meanings ascribed to them in the Stipulation and Agreement of Settlement.

The Court granted Final Approval of the settlement in this matter on November 29, 2011. This settlement provides for the creation of a $49,500,000 settlement fund to be allocated to eligible participants. The defendants deny any wrongdoing.

This settlement involves current and former participants in, or beneficiaries of, the following four Plans between October 1, 1998 and September 30, 2004:

  1. The Merck and Company, Incorporated Employee Savings and Security Plan (now known as the MSD Employee Savings and Security Plan);

  2. The Merck and Company Employee Stock Purchase and Savings Plan (now known as the MSD Employee Stock Purchase and Savings Plan);

  3. The Merck Puerto Rico Employee Savings and Security Plan (now known as the MSD Puerto Rico Employee Savings and Security Plan); and

  4. The plan formerly known as the Merck-Medco Managed Care LLC 401(k) Savings Plan (the “Medco Plan”)


It is the expectation of Counsel that the settlement monies will be made to participant plan accounts in April 2012.
